Senate approves bill on protecting delivery riders from ‘hoax orders’

Remember all those viral posts about delivery riders being victims of “no-show” buyers and prank orders? Those heartbreaking incidents could be a thing of the past as the Senate of the Philippines gave a final nod to a bill to protect them from hoax orders or canceled bookings.

Senate Bill (SB) No. 2302, or the proposed Food, Grocery, and Pharmacy Delivery Services Protection Act was approved with 23 affirmative votes, no negative votes, and no abstentions on January 17.

The proposed measure seeks to criminalize acts such as fake delivery bookings, cancelation of confirmed orders, and the refusal to receive unpaid orders. It also prohibits food, grocery, and pharmacy delivery service app providers from requiring their riders and drivers to shell out money in advance for the fulfillment of the orders.

Under the bill, these delivery service app firms are required to “establish a mandatory reimbursement scheme in favor of delivery riders and drivers in case of cancellation of confirmed orders.”

SB No. 2302 also requires the implementation of Know-Your-Customer (KYC) rules, which call for the submission and verification of proof of identity and residential address of customers, subject to compliance with the Data Privacy Act of 2012.

Senate Bill 2302 was authored by Senators Manuel ‘’Lito’’ Lapid, Aquilino “Koko” Pimentel III, Joel Villanueva and Majority Leader Juan Miguel “Migz” F. Zubiri. It was sponsored by Pimentel.

Pimentel explained in a press release that the rising cases of unjust order cancellations and there’s an urgent need for the Senate to protect delivery riders. He added, ‘Not only is this bill very timely during this pandemic, this measure will be relevant even after the pandemic because the internet has made all of us accustomed to online transactions and made many of us reliant on delivery services.’
