The baby from Nirvana’s iconic album cover is now suing the band
When someone mentions the band Nirvana, you’d recall a couple of tracks or their legendary frontman, Kurt Cobain. But somewhere deep in your memory is its Nevermind album cover showing a naked baby underwater reaching a dollar bill. Spencer Elden, the infant in the photo who is now a 30-year-old man, sued the band for child pornography.
Elden explained that his parents never signed a form that allows the use of his image. Legal papers filed read, ‘The images exposed Spencer’s intimate body part and lasciviously displayed Spencer’s genitals from the time he was an infant to the present day.’
Elden filed a federal lawsuit and asked for $150,000 (approximately Php. 7.4 million) in damages from the band members, Kurt Cobain’s estate, photographer Kirk Weddle, Universal Music, Geffen Records, Warner Records, and MCA Music.
‘Defendants knowingly produced, possessed, and advertised commercial child pornography depicting Spencer, and they knowingly received value in exchange for doing so,’ stated the legal papers.
Years after the album’s release, Elden still celebrated his part in the band’s cover. He actually recreated the same pose, but with clothes on, for the album’s 10th, 17th, 20th, and 25th anniversaries.
However, Elden was frustrated over not receiving compensation for the album cover, according to a 2016 interview with Times Magazine. He said, ‘It’s hard not to get upset when you hear how much money was involved.’
‘[When] I go to a baseball game and think about it: ‘Man, everybody at this baseball game has probably seen my little baby penis,’ I feel like I got part of my human rights revoked,’ he added.
Kirk Weddle, who took the iconic baby photo, said in an interview with The Guardian that he thinks Elden is conflicted about the picture. He said, ‘I think he deserves something. But it’s always the record labels that make the money.’
